Description
The research project investigates the processes of formation and interpretation of contemporary international law, in a context characterised by a growing intertwining of formal sources, subsidiary means for determining legal norms, and soft law instruments. The investigation aims to clarify the interaction between the elements referred to in the mechanisms of production and consolidation of norms, with particular attention to the role of courts, tribunals, and other actors in the definition of international law. The resulting theoretical and methodological framework will provide criteria for assessing the resilience of the system of sources with respect to changes in international society, verifying how the latter manages to adapt to new global and governance challenges through the interaction between formal and informal international sources
