Description
The project falls within a methodological approach that identifies the Italian Constitutional Charter as a source capable of shaping the content of relationships between private parties. It aims to provide an assessment of the impact of the international and European sources referred to in Article 117 of the Constitution on Private Law and its traditional categories. The dialogue between domestic courts and the European High Courts produces legal solutions that foster the development of a European legal culture, leading to a reinterpretation of traditional categories of private law. In particular, principles such as sustainability prompt encourage the emergence of new protective instruments and new needs that require the development of novel remedies.
