Description
The research activity is focused on the study of the civil liability of the Catholic hierarchy and ecclesiastical bodies for damage caused by sexual abuse of minors committed by clerics, with particular regard to jurisprudential and comparative law profiles. The candidate must examine the results achieved by national doctrine and jurisprudence in the reconstruction of this liability, often framed as non-contractual. Then, he will have to examine the legal framework of the phenomenon in other legal systems, both civil and common law, mainly Europeans and Anglo-Saxons, where paedophilia is more widespread, as well as the most recent decisions of jurisprudence, both national and foreign. The analysis of different normative experiences should lead the candidate to a reflection on interesting normative solutions for a better framing of the phenomenon in the domestic legal system and on possible preventive and restorative options.
