12/GIUR-15 - Roman Law And Foundations Of European Law
Description
The project aims to investigate the origins and features of the right of asylum and reception in the ancient world. Particular attention will be given to its earliest manifestations in the Greek world and to its subsequent developments in ancient Rome. The first section focuses on the city of Athens between the fifth and fourth centuries B.C. lt examines the development of asylum within this specific historical and cultural context. The analysis is based on selected sources used to explore the institutions of τὁ ἄσυλον, understood as a 'sacral' right of asylum, and ἱκεσία, defined as supplication aimed at obtaining reception. The project seeks to determine whether τὁ ἄσυλον entailed automatic applicability and whether the two institutions were correlated. The second part undertakes a comparison between the Athenian right of asylum and Roman asylum. lt begins with an examination of the origins of Roman asylum. On this basis, it addresses severaI questions.
