Description
The project attempts to reconcile human rights with shari?ah by investigating the dynamics affecting and moulding the migration routes of nationals of Muslim-majority-countries and their (long-term or temporary) settlement projects in Europe. Italy becomes a privileged observatory to investigate migratory paths unfolding across several concurring normativities, while being a litmus test of patterns developed in other (extra-)EU countries. Within the above-described framework and three main thematic areas - family and minors' law; immigration and asylum law; and health law and bioethics - we will: identify and analyse relevant legal sources and (un)published case law from Italy and other European countries; examine relevant national and international literature; undertake a comparative legal, jurisprudential and doctrinal study of the sources examined; and develop an interdisciplinary theoretical-conceptual analysis.
