Description
The research explores private international law issues arising from the cross-border provision of healthcare services between EU Member States. In particular, it covers the identification of the place where damage occurs and the law applicable to telemedicine, remote diagnosis and prescription, the mobility of medical personnel and the circulation of gametes for medically assisted reproduction. In light of the current legal framework, the study assesses the compatibility of the existing conflict of laws rules on contractual and non- contractual liability with the objectives pursued by the EU legislator in protecting injured patients, with specific regard to personal injury and related compensation mechanisms, including tort claims. The research highlights the need for closer coordination between substantive and private international law to ensure effective patient protection and adequate compensation in cross-border healthcare contexts.
