Description

Title of the project: "Mutual recognition in criminal matter through the lenses of cooperation with Third States". The TRIANGLE-EU research project aims to strengthen mutual recognition in the EU in cases where a third country requests a Member State (MS) to extradite a citizen of another MS. In its 2016 Petruhhin judgment, the CJEU ruled that an MS is obliged under EU law to refuse the extradition of a citizen of another MS if the objective of avoiding impunity can be achieved within the Union, which normally requires the use of the EAW. According to Eurojust and the European Judicial Network, however, MS rarely manage to prioritize the EAW..Omissis.
